CNN —The judge overseeing the Fulton County election racketeering case declined Tuesday to send one of Donald Trump’s co-defendants to jail over recent social media posts and other comments he made targeting witnesses. Prosecutors in Atlanta will ask a judge on Tuesday to revoke the bond of Harrison Floyd, who was indicted along with former President Donald J. Trump in the Georgia election interference case. The district attorney overseeing the case filed a motion last week accusing Mr. Floyd of intimidating potential witnesses through his social media posts. Mr. Floyd’s lawyers argued in a new filing that the posts were not intimidating. Moreover, they noted that Mr. Trump himself had issued provocative social media posts about the case, and that no action had been taken against him. The indictment charges Mr. Trump and his co-defendants with orchestrating a “criminal enterprise” to reverse the results of the 2020 election in Georgia.

ATLANTA (AP) — The Georgia prosecutor pursuing a case against former President Donald Trump and others on Wednesday asked a judge to revoke the bond of defendant Harrison Floyd, saying he has been intimidating witnesses and codefendants in the case. Floyd, Trump and 17 others were indicted in August by a Fulton County grand jury, accused of participating in a wide-ranging scheme to illegally try to overturn the 2020 election in Georgia. The charges against Floyd stem from allegations of harassment of Ruby Freeman, a Fulton County election worker who had been falsely accused of election fraud by Trump and his supporters. Chris Kachouroff, an attorney for Floyd, said District Attorney Fani Willis' attempt to revoke his client's bond was nonsense, adding, “She's not going to get it granted." In addition to the charges in Georgia, Floyd also faces federal charges that accuse him of aggressively confronting two FBI agents sent to serve him with a grand jury subpoena.

Donald Trump on Wednesday offered to "exchange" his right to a speedy trial in his Georgia election-conspiracy case for an Atlanta judge ruling that would have the former president tried separately from 18 other defendants. Trump's co-defendant Mark Meadows, who served as his White House chief of staff, shortly afterward filed an identical offer waiving a speedy trial in exchange for his own case being tried separately. Fulton County Superior Court Judge Scott McAfee has yet to rule on the severance requests that Trump, Meadows and 10 other defendants have filed. It is by no means clear that McAfee would grant severances based on waivers of speedy trial. Trump and the other defendants have the absolute right to a speedy trial in the case.

The prospect of a costly legal defense has prompted some defendants to find other ways to raise money. Paying the legal bills of his co-defendants in Georgia could help the former president keep them all unified as they fight the Fulton County charges. None of the defendants has pleaded guilty, but it is common for criminal defendants facing mounting legal bills to end their cases without the time-consuming costs of a trial.

A judge set bond Tuesday for the only defendant in the Georgia election interference case who was jailed after surrendering to authorities last week. All of the other defendants, including Trump, were released last week on bond after they were booked. A judge in Atlanta set a Friday morning hearing for Harrison Floyd, a co-defendant in former President Donald Trump's election interference case in Georgia who has been held in custody since Thursday afternoon. Floyd, like most of the 19 co-defendants in Atlanta District Attorney Fani Willis' sprawling RICO case, surrendered at Fulton County jail this week ahead of a Friday deadline. Floyd did not do this and therefore "is in custody at the Fulton County Jail," the Fulton County Sheriff's Office said in a statement Thursday.
